Title IX’s Three-Part Test for Athletics Participation

The course discusses the athletics provisions issued under Title IX of the Education Amendments of 1972 and several state-law equivalents, particularly the controversy over Title IX's so-called "Three-Part Test" and the use of new regulatory guidance to alter prior regulations or guidance.  The course covers the following areas:

  • Outlines the various statutory and regulatory provisions relevant to athletics programs under Title IX;
  • Federal agencies' regulatory powers to implement civil rights laws;
  • Administrative-procedure laws on agencies supplanting regulations and prior guidance with new guidance;
  • Federal agencies' sovereign immunity from direct challenges to their regulations and guidance;
  • Whether and when Title IX's implied private right of action and §1983 authorize athletics-based litigation against schools; and
  • Administrative enforcement of federal civil rights laws and regulations.

The course is presented by Larry Joseph, counsel to various athletic groups challenging the Three-Part Test in litigation against the U.S. Department of Education and its officers.
